MINUTES OF SPECIAL MEETING
MASSILLON CITY COUNCIL
HELD, MONDAY, JANUARY 26, 2015
6:00 p.m. 

COUNCIL PRESIDENT TOWNSEND – This Special Meeting will come to order.  This Special Meeting was called by Mayor Kathy Catazaro-Perry for the purpose to discuss and pass Ordinances No. 5 - 2015, No. 6 - 2015 and No. 7 – 2015.  Madam Clerk, roll call please.

Roll call for the evening found the following Council Members present:  Milan Chovan, Michelle Del Rio-Keller, Nancy Halter, Ed Lewis, Paul Manson, Andrea Scassa, Megan Starrett and Shaddrick Stinson.

Roll call of 8 present; Councilwoman Sarita Cunningham-Hedderly was absent.

COUNCIL PRESIDENT TOWNSEND – Thank you.  I need a motion to excuse Councilwoman Cunningham-Hedderly.

COUNCILMAN STINSON – I motion that we excuse Councilwoman Cunningham-Hedderly.

COUNCIL PRESIDENT TOWNSEND – Seconded by Councilman Manson.  Roll call to excuse Councilwoman Cunningham-Hedderly.

COUNCIL PRESIDENT TOWNSEND – Okay, I would like to make a note that Councilwoman Cunningham-Hedderly just entered the meeting.  Welcome.  Okay, Ordinance No. 5.

ORDINANCE NO. 5 – 2015                       BY:  PARKS & RECREATION COMMITTEE

AN ORDINANCE authorizing the Mayor of the City of Massillon, Ohio, to enter into a Trailway Easement Agreement on behalf of the City of Massillon, as Grantor, with the Stark County Park District, an Ohio Political Subdivision, in Canton, Ohio, as Grantee, and declaring an emergency.

COUNCIL PRESIDENT TOWNSEND – Councilwoman Del Rio-Keller.

COUNCILWOMAN DEL RIO-KELLER – Thank you, Mr. President.  As we talked last Tuesday, Ordinance No. 5 is the easement granting for the Stark Parks.  This is something that would really benefit them.  I mean, they took the Cottrill property, they were also looking to take over which is listed in these easements as well, the plus to the City is that they’ll maintain it, they’ll do everything with it; we just don’t have to worry about it.  Any questions or discussion?  Mr. Nist is here if we need to call him up.  Paul.

COUNCILMAN MANSON – My question is was it necessary for us to have an emergency meeting for this ordinance? 

COUNCIL PRESIDENT TOWNSEND – Well, it was called by the Mayor, I mean, if she’s willing to come up and explain why she decided that it was necessary to call a Special Meeting we can ask her to come up or Mr. Nist.

COUNCILWOMAN DEL RIO-KELLER – I’ll comment.  I did talk to the Mayor about this ordinance.  This is not the one in particular that she was looking to get passed tonight.  My thought was, I wanted to give it time to be in the paper.  So, it was in the paper on Wednesday, it was also in the paper on Saturday.  So, I’m completely comfortable putting this forward if your all comfortable doing it. 

COUNCIL PRESIDENT TOWNSEND – Councilman Manson.

COUNCILMAN MANSON – I’m not.

COUNCIL PRESIDENT TOWNSEND – Councilwoman Halter.

COUNCILWOMAN HALTER – I’m not either.

COUNCIL PRESIDENT TOWNSEND – Well, here’s the problem that we face.  We have the meeting here it’s up to the Chairperson if she decides to make it first reading or second reading or whatever she chooses to do, but, the meeting is here.  I don’t think we can do anything about that, so.

COUNCILWOMAN DEL RIO-KELLER – I would go ahead and give this second reading only because I know this is a win-win and I’d like to see all of us unanimously vote, so, second reading.

COUNCIL PRESIDENT TOWNSEND – Okay.  Ordinance No. 5 has received second reading.  Ordinance No. 6.

ORDINANCE NO. 6 -2015                  BY:  STREETS, HIGHWAYS & TRAFFIC COMMITTEE

AN ORDINANCE authorizing the Director of Public Service and Safety of the City of Massillon, Ohio, to sign the Participatory Legislation with the Ohio Dept. of Transportation (ODOT), for SR 236 Resurfacing Project, PID 94125, for the year ending December 31, 2015, and declaring an emergency.

COUNCIL PRESIDENT TOWNSEND – Thank you.  Councilwoman Halter.

COUNCILWOMAN HALTER – Second reading.

COUNCIL PRESIDENT TOWNSEND – Thank you.  Ordinance No. 6 has received second reading.  Ordinance No. 7.

ORDINANCE NO. 7 – 2015                 BY:  STREETS, HIGHWAYS & TRAFFIC COMMITTEE

AN ORDINANCE authorizing the Mayor of the City of Massillon, Ohio, to apply for 2015 Municipal Road Funds through Stark County for the year ending December 31, 2015, and declaring an emergency.

COUNCIL PRESIDENT TOWNSEND – Councilwoman Halter.

COUNCILWOMAN HALTER – Thank you, Mr. President.  I know that there is a lot of discussion that still needs to be made on this ordinance.  I would like to talk to, at least, my two other committee people, which would be Mrs. Starrett and Mr. Manson, as to whether you would like to discuss it tonight or would you want to wait until the regular meeting next Monday to discuss it?

COUNCIL PRESIDENT TOWNSEND – Councilwoman Starrett.

COUNCILWOMAN STARRETT – I mean, I do have some questions, so, I don’t know if you’d be willing to maybe ask Mr. Dylewski to come up or the Mayor to come up, or whoever, or we can wait until the regular meeting.  It’s up to you, Nancy, but I do have some questions on this and I think a lot of people do have some questions on this ordinance.

COUNCIL PRESIDENT TOWNSEND – Councilman Manson.

COUNCILMAN MANSON – We can discuss it now or we can discuss it in Committee, if it doesn’t pass; either way.  It doesn’t matter to me.  I mean, it’ll be on our agenda for a Committee meeting tonight.  You know, we’ll be going through everything.

COUNCILWOMAN HALTER – Okay.  Give it second reading then.

COUNCIL PRESIDENT TOWNSEND – Thank you, Councilwoman Halter.  Ordinance No. 7 has received its second reading.  That concludes this Special Meeting.  Massillon City Council Special Meeting is adjourned.
